Terms of Service

Important: By downloading, installing or using SmartScan, you agree to these Terms. If you do not agree, do not use the service. These Terms constitute a legally binding agreement between you and Secure Path Ltd.

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the SmartScan Forensic mobile applications for iOS and Android ("the Service"), and this website at smartscanforensic.com, operated by Secure Path Ltd ("Company", "we", "us", "our").

By using SmartScan you agree to be bound by these Terms and our Privacy Policy. If you use SmartScan on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Definitions

  • "Service" — the SmartScan mobile apps, back-end analysis platform and this website
  • "User" / "you" — any individual accessing the Service
  • "Device UID" — the random identifier generated locally by the app at first launch
  • "Content" — files, data, reports and materials captured or generated
  • "PCAP" — packet capture file containing network traffic data
  • "Analysis" — the forensic examination of a PCAP for spyware indicators
  • "Report" — the output document generated from an Analysis
  • "Scan credit" — a unit consumable by starting one Analysis
  • "C-Level Report" — the optional deeper analysis triggered on demand when the base report contains Critical or High alerts, priced at 4 scan credits

3. Service description

SmartScan provides:

  • On-device capture of network traffic through an encrypted WireGuard tunnel
  • Server-side forensic analysis against 200+ spyware signatures
  • Detection of known and suspected surveillance software (Pegasus, Predator, Graphite, Hermit, FinSpy, Candiru, QuaDream, and commercial stalkerware)
  • Generation of PDF forensic reports with MITRE ATT&CK mapping and chain of custody metadata
  • Optional C-Level Report with Bayesian double-verification and JA4+ deep correlation

Service limitations: SmartScan analyses network traffic only. We cannot detect spyware that:

  • Does not communicate over the network during the capture window
  • Uses unknown or undocumented communication protocols
  • Is dormant or uninstalled before the capture
  • Operates exclusively offline or via peer-to-peer physical channels

A negative result does not guarantee the absence of compromise. For high-value targets, consider complementary device forensics.

4. Device profile

4.1 Eligibility

You must be at least 18 years old and legally capable of forming a binding contract, and must not be prohibited from using the Service under applicable laws.

4.2 Device identity

SmartScan does not require registration. On first launch the app generates a random Device UID locally on your device. This identifier is the only means by which we associate scan credits and reports with your device. You are responsible for:

  • Keeping your Device UID confidential (it appears in the app under Settings → About)
  • Any activity performed under your Device UID
  • Immediately notifying us if you believe another party has obtained your Device UID

4.3 Device changes

The Device UID is tied to the app installation. Reinstalling the app or resetting the device generates a new Device UID. Existing scan credits and report history cannot be transferred between UIDs.

5. Acceptable use

SmartScan is designed for legitimate forensic purposes, including:

  • Analysing your own device's network traffic
  • Forensic analysis of a device with the owner's explicit consent
  • Law enforcement investigations with lawful authority
  • Journalist protection and threat modelling
  • Corporate security assessments on authorised devices

6. Prohibited activities

Strictly prohibited:

  • Unauthorised surveillance — using SmartScan to monitor others without legal authority or consent
  • Illegal interception — capturing network traffic in violation of wiretapping laws
  • Evidence tampering — manipulating PCAP files or reports for fraudulent purposes
  • Malware distribution — deliberately injecting active malware traffic into a capture
  • Service abuse — attempting to overwhelm, hack, or exploit the Service
  • Circumvention — bypassing security measures, IAP verification or rate limits
  • Reselling — reselling or redistributing the Service without written authorisation
  • Reverse engineering — attempting to reverse engineer detection algorithms or signatures
  • False representation — misrepresenting your identity or authority
  • Multiple free scans — claiming the "free scan" launch offer more than once per device

Violation may result in immediate termination of scan credits and reporting to law enforcement.

7. Intellectual property

7.1 Our property

SmartScan, including all software, algorithms, detection signatures, user interface, artwork, documentation and the SmartScan Forensic brand, is owned by Secure Path Ltd and protected by intellectual property laws.

7.2 Your content

You retain ownership of PCAP files captured by your device. By using the Service, you grant us a limited, non-transferable licence to:

  • Process and analyse the files to deliver the Service
  • Generate reports based on the analysis
  • Use anonymised, aggregated indicators to improve detection (no PII, no reconstructible original captures)

7.3 Reports

You own the reports generated from your analyses. You may use them for any lawful purpose, including legal proceedings. Reports include our attribution and cryptographic signature — these must be preserved for chain-of-custody integrity.

8. Payment terms

8.1 In-App Purchases

Scan credits are sold exclusively through the platform's native In-App Purchase system:

  • iOS: Apple StoreKit — billed to your Apple ID
  • Android: Google Play Billing — billed to your Google Account

Prices are displayed in-app before purchase. Current pricing: €49 per scan. The C-Level Report is billed at 4 additional scan credits (i.e. €196 equivalent) and is only offered in-app when the base report contains Critical or High alerts.

8.2 Free launch offer

The "1,000 free scans" launch campaign is limited to one scan credit per Device UID. The pool is depleted first-come-first-served. Claims are validated server-side via Cloudflare Turnstile CAPTCHA and rate limits. Attempted abuse (multiple claims, automated submissions, VPN/proxy chaining) will result in the Device UID being blocked from future promotions.

8.3 Taxes and currency

Prices displayed are inclusive of applicable VAT for consumers in the EU, collected and remitted by Apple / Google as intermediaries under EU VAT rules for digital services.

8.4 Failed payments

Failed IAP transactions are handled by Apple or Google according to their respective policies. No scan credit is added until the transaction is verified server-side.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

We disclaim all warranties, express or implied, including:

  • Merchantability and fitness for a particular purpose
  • Accuracy, completeness or reliability of results
  • Uninterrupted or error-free operation
  • Detection of all spyware or threats

9.1 No legal advice

SmartScan provides technical analysis, not legal advice. Reports are informational and should be reviewed by qualified legal professionals before use in proceedings.

9.2 No guarantee of detection

We cannot guarantee detection of all spyware. New threats, zero-days and sophisticated actors may evade detection. A negative result indicates no known indicators were found — not definitive absence of compromise.

10. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential or punitive damages
  • Our total liability is limited to fees paid by you in the 12 months preceding the claim
  • We are not liable for actions taken based on our reports
  • We are not liable for third-party actions or content

These limitations apply regardless of the theory of liability (contract, tort, strict liability, etc.).

11. Indemnification

You agree to indemnify and hold harmless Secure Path Ltd, its officers, directors, employees and agents from any claims, damages, losses or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content

12. Termination

12.1 By you

You may terminate use at any time by uninstalling the app. Uninstallation deletes the local Device UID; any remaining scan credits on our servers become unreachable but are not transferable to a new UID.

12.2 By us

We may suspend or terminate access:

  • For violation of these Terms
  • For suspected fraudulent or illegal activity
  • If required by law
  • For any reason with 30 days' notice pushed via in-app notification

12.3 Effect of termination

Upon termination your access to the Service ends immediately, your data is deleted per our retention policy, and provisions that should survive termination (IP, disclaimers, limitations, indemnification) will survive.

13. Governing law & disputes

13.1 Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Dispute resolution

  1. Negotiation — good-faith attempt to resolve within 30 days
  2. Mediation — if negotiation fails, non-binding mediation
  3. Courts — exclusive jurisdiction of the courts of England and Wales

13.3 Class action waiver

You agree to resolve disputes individually. You waive any right to participate in class actions or collective proceedings.

14. Changes to terms

We may modify these Terms at any time. Material changes will be notified via in-app notification displayed at next launch, prominent notice on the Service website, and at least 30 days before taking effect. Continued use after changes constitutes acceptance.

16. Miscellaneous

16.1 Entire agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms without our consent. We may assign them in connection with a merger or acquisition.

16.5 Force majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
